01 Introduction and Agreement
Welcome to the WeBoCars.com website.
This website, including mobile and online applications (if any) (the "Site") is operated by Webocars Inc, WeBoCars.com, (“Provider"). These Terms of Service apply only to the website located at www.WeBoCars.com, including without limitation any mobile or similar versions. By using the Site, you hereby agree that you are at least eighteen (18) years of age.
02 WeBoCars.com Provides a Quote Service
This Site gives users the ability to request and view up to 3 new vehicle price quotes from participating franchise vehicle dealers ("Dealers") in a designated geographic area via the Provider ("Webocars Quote Process Service").
Provider is not a Dealer, Broker or Agent. The Provider does not sell vehicles and is not a vehicle dealer. Moreover, the provider is not a vehicle broker and does not act as a buyer's or seller's agent. As a result, WeBoCars.com does not (a) guarantee or ensure any vehicle or any transaction between a buyer and seller, (b) collect or process payment or transfer of title on behalf of buyers or sellers, or (c) warehouse, store, ship or deliver any vehicles.
03 Vehicle Prices
Any retail and invoice or final prices provided by this Site are for educational purchase options only and makes best effort to reflect the actual selling price of a particular vehicle and should include additional fees such as government fees and taxes, title and registration fees. The actual selling price and the conditions of sale for a vehicle will be the result of your final agreement with the applicable chosen vehicle dealer.
04 Webocars Inc Process Fees
No fee service for standard users.
There is no fee 1. if and only if the purchaser or lessee purchases or leases a vehicle once a price option or options are provided by the Webocars.com process, or 2. Any Brand/Model vehicle is leased or purchased using the Webocars.com process after 90 Business Days from the provided options dates. In the event any of these violations occurs, a $400 fee will be direct billed or charged to the Webocars Inc inquiring party without notice to their provided address or credit card. In addition the consumer permits a one time credit check at the sole discretion of Webocarscom Inc. to prevent system gaming.
05 Representations/Indemnity
You hereby represent and warrant that (a) you have all necessary authority, rights and permissions to submit the Materials to the Site, (b) the Materials do not and will not infringe or misappropriate any copyright, trademark, trade secret, patent or other intellectual property right of any third party, including any rights of privacy or publicity, and (c) the Materials do not and will not violate any applicable law or regulation including, but not limited to, any automobile advertising laws or regulations, or cause injury to any person.
You agree to release, defend, indemnify and hold WeBoCars.com, its Affiliates, the Licensors, and their respective officers, directors, employees, agents and contractors harmless from and against any and all claims, costs, demands or expenses, including attorneys' fees, arising from (i) any distribution, publication, refusal to publish, removal, deletion, movement, editing or other use of the Materials you provide, (ii) your use of the Site or any reliance on the Content, (iii) your breach of these Terms of Service or (iv) any actual, prospective or terminated sale or other transaction between you and a third party.
06 Prohibited Activities
The following is a partial list of the kinds of activities that are prohibited on or through the Site:
- check_circleSubmitting Material that is patently offensive to the online community, such as content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.

- check_circleEngaging in activity or submitting Material that harasses or advocates harassment of another person.
- check_circleEngaging in activity that involves the transmission of “junk mail” or unsolicited mass mailing or “spam” to WeBoCars.com Users or others.
- check_circleEngaging in activity or submitting Material, or promoting information, that is fraudulent, false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous.
- check_circleSubmitting Material that contains restricted or password-only access pages, or hidden pages or images.
- check_circleSubmitting Material that displays pornographic or sexually explicit material of any kind.
- check_circleSubmitting Material that provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
- check_circleEngaging in activities or submitting Materials that solicit passwords or personally identifiable information for unlawful purposes from other Users.
- check_circleEngaging in commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, barter, advertising and pyramid schemes.
- check_circleUsing the Site's lead forms and/or toll-free numbers to advertise or promote products and services to WeBoCars.com advertisers.
- check_circleUsing any robot, spider or other automatic device, or a manual process, to monitor or copy web pages or the Content contained in the Site or for any other unauthorized purpose without our prior expressed written permission.
- check_circleUsing any device, software or routine to interfere or attempt to interfere with the proper working of the Site.
- check_circleDecompiling, reverse engineering, disassembling or otherwise attempting to obtain the source code for the Software.
- check_circleTaking any action that imposes an unreasonable or disproportionately large load on WeBoCars.com's hardware and software infrastructure (collectively, “Prohibited Activities”).

You understand and agree that in Webocars.com sole discretion, and without prior notice, your access to this Site may be terminated or suspended, and WeBoCars.com may exercise any other remedy available and remove any Materials, if WeBoCars.com believes that your use of the Site and/or any Materials you provide (a) violate (i) these Terms of Service, (ii) the rights of WeBoCars.com, any Affiliate or Licensor, or another User of the Site, or (iii) any law or regulation, or are otherwise objectionable or inappropriate or (b) constitute fraudulent activity of any nature. You agree that monetary damages may not provide a sufficient remedy to WeBoCars.com for violations of these Terms of Service, and you consent that WeBoCars.com is not required to provide any refund to you if you are terminated as an authorized User of the Site because, in WeBoCars.com's sole discretion, you have violated these Terms of Service from beginning to end of the Webocars.com process.
09 Changes to these Terms of Service
We reserve the right to update and periodically amend these Terms of Service at our discretion and at any time. If we make changes to these Terms of Service, amendments will be posted online and the date of update will be included. Your continued use of WeBoCars.com and its affiliated sites after any such update indicates your agreement to the same. WeBoCars.com may modify, suspend, discontinue or restrict the use of any portion of the Site without notice or liability.
10 Choice of Law
Venue. The terms of the Agreement and any dispute relating thereto will be governed by the laws of the State of New Jersey, or as solely Chosen by Webocars Inc. without regard to conflict/choice of law principles. You and we agree to submit to the exclusive jurisdiction of the state and federal courts located in Essex County, New Jersey or as chosen solely by Webocars Inc.
